PHOTOGRAPHY TERMS AND CONDITIONS

1. PAYMENT TERMS:

  • Deposit Requirement: A 50% deposit is required to reserve your session date. This deposit is non-refundable.

  • Remaining Balance: The remaining balance of the session fee is due on the day of the session.

  • Accepted Payment Methods: The deposit must be made via bank transfer or UPI. The remaining balance can be paid online or in cash. Cheques are not accepted.

2. CANCELLATION & RESCHEDULING:

  • Rescheduling Policy: Clients must provide at least 24 hours' notice to reschedule. The deposit can be applied to the new date.

  • Last-Minute Rescheduling: If rescheduling occurs within 24 hours of the session, a fee of ₹3000 will be charged.

  • Cancellations: Deposits and payments are non-refundable in case of cancellations.

3. NON-REFUNDABLE PAYMENTS:

  • Payments are non-refundable in the event of cancellation or postponement.

  • Refunds, rescheduling, or compensation will not be provided for unreasonable claims of dissatisfaction.

  • Quality Control: Priyanka Modh Photography® ensures the highest artistic and technical standards while maintaining full creative discretion.

4. CLIENT RESPONSIBILITY & NO SHOWS:

  • Client Responsibility: Clients must ensure that all individuals arrive on time and prepared. The photographer is not responsible for uncooperative individuals.

  • No Shows: If the client or key individuals fail to appear at the scheduled session, the deposit is forfeited.

5. SUBJECTS & SESSION CONDUCT:

  • Client Control: The client is responsible for managing the behavior of all additional subjects (e.g., siblings, family members) during the session.

  • Newborn Sessions: To maintain a calm and safe environment, no additional subjects may interfere with the baby's area.

6. FAILURE TO PERFORM:

  • Unforeseen Circumstances: If the photographer is unable to perform due to illness, emergency, or any situation beyond control (e.g., fire, accident, weather), both parties will make every effort to reschedule.

  • Technical Failures: If equipment malfunctions or files are lost, liability is limited to rescheduling.

7. STUDIO & ATTENDANCE RULES:

  • Only parents of the baby are allowed in the studio.

  • Unless prior approval is granted, family members, relatives and friends are not permitted.

  • If more than two adults are present without approval, the session will be canceled.

8. PHOTOGRAPHY & VIDEO RESTRICTIONS:

  • No Personal Photography: Clients are not permitted to take photos, record videos, or make video calls during the session.

9. EDITING & DELIVERY:

  • Standard Editing Includes: Retouching, exposure correction, color correction, and cropping.

  • Not Included: Hair color changes, extreme scarring removal, background replacements, or major alterations.

  • Editing Style: Images will be edited in our artistic style and will not be altered to match other preferences.

  • Delivery Timeline: Clients must select their preferred images within 3 days of receiving proofs. Final edits will be delivered within 20-25 days. Delays in selection will delay delivery.

10. COPYRIGHT & IMAGE USAGE:

  • All images are copyrighted under the Indian Copyright Act, 1957.

  • Clients receive a limited, non-exclusive license for personal use only.

  • Priyanka Modh Photography® retains full copyright and may use images for portfolio and promotional purposes unless privacy is purchased.

11. PRIVACY POLICY & LICENSING OPTIONS:

  • Privacy Policy Option: Clients may purchase a Privacy Policy to prevent images from being shared online. This must be selected and paid for at the time of booking.

  • Licensing Option (Included in Package): Clients receive the right to use photos for personal use while Priyanka Modh Photography® retains full ownership.

12. LOGO & WATERMARK POLICY:

  • Print Photos: Provided without logos.

  • Online Photos: Will include the Priyanka Modh Photography® logo, and the position cannot be altered.

  • Session Previews: Low-resolution previews will be watermarked.

13. DIGITAL FILE STORAGE:

  • File Retention: We store RAW files for 10 days after the session. Clients must back up their final images immediately upon receipt.

14. LIMIT OF LIABILITY:

  • Care & Responsibility: The photographer ensures the utmost care in handling digital files and session execution.

  • File Loss: If originals are lost due to technical issues, liability is limited to rescheduling.

  • Print Quality Disclaimer: We do not guarantee the quality of prints made from external labs.

  • Injury Waiver: Clients are responsible for their safety and that of their children. The photographer is not liable for any injuries during the session.

 

15. Communication & Disputes

Call Recording Consent

  • We may record business calls for quality assurance, transparency, and documentation. By continuing the call, you consent to such recording in compliance with Indian laws. Recordings will not be shared except as required by law.

Dispute Resolution:

  • Concerns? Email us first—we’ll work to resolve issues fairly.

  • Complaints must be shared respectfully via email. Demands for free services or unreasonable claims will not be honored.

  • Legal jurisdiction: Ahmedabad, Gujarat, India.
